1Who we are, and what these terms cover
These terms of service (the terms) are an agreement between you and MedMatrix Pty Ltd (ABN 37 701 007 061), trading as OSCE World (we, us, our). They cover your use of OSCE World, our website at osceworld.com, the application served at osceworld.com/app, and any related applications and services (together, the service).
By creating an account, signing in, or otherwise using the service, you agree to these terms, to our Privacy Policy, and to our Usage Policy. All three form part of this agreement.
We also publish an End User Licence Agreement, which governs your licence to use our software and will apply to our mobile applications when they are released. If anything in the End User Licence Agreement is inconsistent with these terms, these terms prevail.
If you do not agree, please do not use the service.
If you are using the service on behalf of a university, hospital, college or other organisation, you confirm that you are authorised to accept these terms for that organisation, and you means both you and that organisation.
2Who can use the service
You must be at least 16 years old to create an account. If you are under 18, you confirm that a parent, guardian or your enrolling institution has agreed to your use of the service.
The service is built for medical, nursing and allied health students, junior doctors, educators and institutions. You need to give accurate registration details and keep them up to date.
Some accounts are created through an institution rather than by signing up directly, and some require a join code or approval from a facilitator. Access granted that way remains subject to these terms.
3What OSCE World is
OSCE World provides simulated Objective Structured Clinical Examination practice stations. An AI system plays the part of a fictional patient so that you can rehearse history taking, clinical communication and reasoning. At the end of a station, the service generates a score against a marking scheme, together with written feedback and a summary.
The service also provides tools for facilitators and institutions to manage classes, review student results and control access to case content.
The simulator is conversational. It assesses history taking and communication. It does not assess physical examination or practical procedures, and it is not a substitute for the parts of your training that require hands-on practice with real people.
We are not affiliated with, endorsed by, or accredited by any medical school, royal college, examining board or registration authority. That includes the Australian Medical Council, the Royal Australian College of General Practitioners, the Australasian College for Emergency Medicine, the General Medical Council and every other body responsible for a clinical examination. Where we name an examination format or a body, we do so only to describe what our stations are modelled on. Practising here does not guarantee any outcome in an examination.
4A training tool, not an official assessment
Please read this section carefully.
The service is a training tool. It does not provide medical advice, diagnosis or treatment, to you or to anyone else, and it must never be used to make or inform a decision about the care of a real person.
Every patient, scenario, score and piece of feedback in the service is fictional and automatically generated. Clinical content may be incomplete, out of date, internally inconsistent or simply wrong.
4.1How to read your marks
Our marking is a guide only. Three things about it are worth knowing before you take a score to heart.
The standard is deliberately high. The mark required to pass a station on OSCE World is set above the standard used by a number of universities, medical councils and boards. A score below our pass mark does not mean you would fail the same station in your own examination.
The marking can miss things. The score is generated by an AI system reading a transcript. It can fail to credit a point you actually made, or a question you actually asked, particularly where you phrased it in an unusual way. It can also credit something more generously than a human examiner would.
A technical fault can cost you a mark. The service depends on a live network connection. A brief interruption during a station can mean part of what you said does not reach us, and anything that does not reach us cannot be marked. Section 11 explains what we will do about it.
Always check your own university's marking criteria and evaluation standards. Where something in the service conflicts with what your institution teaches, follow your institution.
4.2What the service is not
Nothing in the service creates a doctor and patient relationship, a clinician and patient relationship, or any professional advisory relationship between you and us.
The service does not replace accredited clinical education, supervision by a qualified clinician, your institution's curriculum, or your own professional judgement. It is not a qualification, an accreditation, or a predictor of your result in a real examination, and passing or failing a simulated station means nothing about how you will be assessed by your school.
You are responsible for checking any clinical content against current guidelines and your institution's teaching before you rely on it for any purpose.
4.3If practising is getting to you
Examination preparation is stressful, and a low score on a simulated station is not a verdict on you. The simulated patient is software. It is not a clinician, a counsellor, or a source of support in a personal crisis, and it should not be used as one.
If practising here is causing you distress, please stop and speak to someone: your university's student support service, your supervisor, your own doctor, or a support line. If you tell us that the service has affected you, we will listen and we will help you close or pause your account.
5AI generated content
Simulated patient replies, scores, marking breakdowns and written feedback are produced by third party artificial intelligence models. Where you turn on voice features, third party speech services convert your speech to text and, on paid plans, generate the patient's voice.
This content is generated automatically. No clinician reviews it before it is shown to you. Results are probabilistic, which means the same station can produce different responses and different marks on different attempts, and identical answers may not always be scored identically.
You are interacting with software, not with a person.
We use reasonable care in designing our cases, marking schemes and prompts, but we do not warrant that AI generated output will be accurate, clinically correct or fit for any particular purpose, beyond the guarantees described in section 16 that cannot be excluded.
6Your account
You are responsible for keeping your login details confidential and for activity that happens under your account. Accounts are personal to you. Please do not share your credentials, let someone else use your account, or use an account that is not yours.
Tell us promptly at [email protected] if you think someone else has accessed your account.
We may need to verify your email address before some features become available, and we keep a record of administrative actions taken on accounts for security purposes.
7Institutions, facilitators and classes
If your account is connected to an organisation, or you join a class using a join code, people at that organisation will be able to see information about your use of the service.
- Facilitators can generally see the results, transcripts and feedback of students in their classes, can leave comments on them, and can place a class into examination conditions.
- Organisation administrators can manage members, class rosters and access to case content within their organisation.
- We administer the service as a whole and can access data where necessary to operate, secure and support it.
If your email address is on a domain belonging to an organisation we already work with, your account may be linked to that organisation automatically when you sign up. Our Privacy Policy explains what that means for your information.
If your institution provisions or manages your account, its own policies will also apply to you, and it may ask us to change or remove your access. Where your institution decides how your information is used for its own purposes, that use is its responsibility rather than ours, and requests about it may need to go through them.
Anyone holding a facilitator or administrator role must use that access only for legitimate educational and administrative purposes, and must not export, publish or share another person's data beyond what the role is designed to allow.
If you would rather your school did not see your practice, use a personal account that is not connected to it.
8Acceptable use
Our Usage Policy sets out what you may and may not do with the service, and what happens if you breach it. It forms part of this agreement, and we may update it without reissuing these terms.
In summary, and without limiting that policy, you agree not to:
- break any law, or use the service for anything unlawful, harassing, defamatory or fraudulent;
- enter real patient information, or any identifiable health information about another person, into the service. Cases are fictional and the service is not built or approved to hold real clinical records;
- try to extract our system prompts, model instructions, marking logic or case content, whether by prompt injection, jailbreaking or any other means;
- copy, scrape, bulk download, republish, resell or redistribute our cases, marking schemes, feedback or other content, or use them to train or evaluate another AI system, without our written permission;
- reverse engineer, decompile or attempt to derive the source code of the service, except to the extent the law says you may;
- probe, scan or test the security of the service, bypass authentication, rate limits or access controls, or access data that is not yours;
- use bots, scripts or automated tools against the service without our permission, or place unreasonable load on it;
- share your account, sell access to it, or use the service to impersonate anyone;
- upload malicious code, or anything that infringes another person's intellectual property or privacy;
- present output from the service as your own original clinical assessment, or use it in a way that breaches your institution's academic integrity rules.
If you find a security vulnerability, please report it to [email protected] rather than exploiting it or publishing it. We will not pursue action against someone who identifies and reports a genuine issue in good faith, gives us a reasonable chance to fix it, and does not access or destroy other people's data in the process.
9Your content
Your content means what you put into the service, including your messages during a station, your written post-station presentation, any audio you speak where voice input is enabled, and feedback you send us.
You keep ownership of your content. You give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit, display and process it, but only so far as is needed to:
- run the service for you, including generating patient replies, scores and feedback;
- show your results to your facilitator or institution where your account is connected to one;
- keep the service secure, and investigate suspected misuse;
- meet a legal obligation.
We may also use information about how the service is used, in aggregated or de-identified form that cannot reasonably identify you, to improve our cases, marking schemes and product. If you would prefer your content not to be used even in that form, email [email protected] and we will honour that.
This licence ends when your content is deleted, except for backup copies still on their normal deletion cycle, and for anything we must keep by law. It does not let us sell your content or publish it in a form that identifies you.
10Our intellectual property
The service belongs to us and is protected by intellectual property law. That includes its software, design, branding and documentation, and it includes our case library and marking sheets: the selection and arrangement of the stations, the structure and scoring criteria of the marking schemes, and the specifications we write them to. As section 5 explains, individual simulated patient replies, scores and written feedback are generated at the point of use, and we do not claim ownership of any particular generated sentence. Your content is yours and is not covered by this section.
While your account is active and you are complying with these terms, we give you a limited, personal, non-exclusive, non-transferable licence to use the service for your own education and training, or, for institutional users, for teaching and assessing your own students. Every other right is reserved.
You may download or print your own results for your personal study and portfolio. That does not extend to our case content or marking schemes.
11Availability, faults and technical problems
We aim to keep the service running well, but we do not promise it will be available without interruption. It may be unavailable during maintenance, updates, or because of a problem with a third party we depend on.
If a technical fault on our side affects a station (a dropped connection, a failed transcription, a station that does not mark or marks incompletely), tell us at [email protected] and we will re-run that station for you free of charge, or credit it back to your plan. This is in addition to your rights under section 16, and does not limit them. We would rather give you the station back than argue about a mark.
A station that has already begun always finishes and is always marked in full, even if your plan expires part way through it.
We may add, change or remove features, including cases, as the product develops. If we make a change that materially reduces the core functionality you are paying for, we will give you reasonable notice and, if you hold a paid plan, you may cancel and receive a proportionate refund for the part you have paid for and not used.
We may discontinue the service. If we do, we will give you reasonable notice where we can, and a fair opportunity to export your results first.
12Plans, prices and payment
Every new account gets a small number of free stations so you can see what the marking looks like before you decide whether to pay for anything. Beyond that, access is sold as a plan: either a single station, or a pass that opens the library for a fixed period. The current plans, prices and limits are shown on the Passes screen in the app before you buy, and that screen is the authoritative statement of what is on sale at any time.
Every plan is a one-off payment for a fixed period. Nothing renews automatically, we do not store a payment method to charge you again, and there is no subscription to cancel. When a pass runs out your account stays open and simply returns to what it could do before.
12.1Currency and tax
Prices are shown and charged in United States dollars, and are marked "US$". The price shown is the total amount you pay us. For customers in Australia it includes GST; supplies to customers outside Australia are GST-free.
Your own bank may apply a currency conversion or international transaction fee. That charge is between you and your bank, and we do not receive any part of it.
If you need a tax invoice, email [email protected] and we will issue one showing our ABN and the GST amount in Australian dollars.
Payments are handled by Stripe. We never see or store your full card number.
12.2Upgrade credit
If you buy a smaller plan and then a larger one within the credit window shown in the app, the highest amount you have paid within that window comes off the larger plan. The credit applies each time you move to a larger plan, not once per account. It applies only to a plan that costs more than the one it is credited from, and it cannot be exchanged for cash or a refund.
12.3Daily limits
Passes are generous rather than unlimited. Each plan carries a limit on how many stations you can start in a day, set out here rather than on the purchase screen because reaching one is so unlikely. The limits are currently ten stations a day on the Day Pass and fifteen a day on the Week and Month Passes. A single station plan is one station. If you do reach one, the app tells you at the time and tells you when it resets.
These limits are set above what each plan sells, so reaching one cannot reduce the number of stations you paid for. A Week Pass sells twenty-five stations across seven days; the limit would only bite if you tried to sit more than fifteen of them in a single day.
The limits exist for two reasons, and we would rather say both than hide behind the phrase "fair use". Every station costs us real money to run, because a live conversation and its marking are generated for you each time. And a plan is sold for one person: a daily limit is what stops one account being shared across a whole year group.
A limit resets each day. Reaching one does not shorten your pass, cost you anything, or count against you in any way, and it never affects the marking or feedback for a station you have already started. If you have a genuine reason to need more than the limit allows, for example a teaching session you are running, write to us at [email protected] and we will sort something out.
12.4Changes to plans and prices
We may change plans, prices and limits in future. A change will not reduce what you have already paid for: a pass you hold keeps the price, the station allowance and the limits it was sold with until it expires.
Some plans are offered at an introductory price while we are getting started. Where a plan is on an introductory price we will say so on the Passes screen at the time you buy. An introductory price is time-limited and the plan is expected to cost more later; when it ends, the change applies only to purchases made after that date, and any pass you already hold is unaffected for the reasons in the paragraph above.
13Refunds
If a plan did not work as described, or something on our side stopped you using what you paid for, tell us at [email protected] and we will put it right by fixing the problem, re-running the affected stations, or refunding the part you could not use.
Stations you have already sat are not refundable, because the content is delivered as you use it.
These arrangements are in addition to, and do not reduce, your rights under the Australian Consumer Law described in section 16 or under section 17 if you are outside Australia.
14Suspension and ending your account
You can stop using the service at any time, and you can ask us to delete your account by emailing [email protected].
We may suspend or end your access if you seriously or repeatedly breach these terms or our Usage Policy, if we are required to by law, or if your continued access presents a genuine security risk to the service or to other users. Except where the breach is serious, unlawful or presents an immediate risk, we will tell you what the problem is and give you a reasonable chance to fix it before we suspend or terminate.
If we end your access for a reason that is not your fault, and you have paid for something you have not used, we will refund the unused part.
If your account is connected to an institution, that institution may also remove your access to its classes and content.
Sections that by their nature should continue after termination will continue, including sections 4, 5, 9, 10, 16, 17, 18, 19 and 22.
15Services we rely on
The service depends on third parties, including an AI model provider, a speech provider for voice features, a cloud hosting provider, an email delivery provider and a payment processor. Our Privacy Policy names them and explains what each one receives.
We choose these providers with reasonable care and remain responsible to you for the service we provide. Where you deal with a provider directly, for example at a payment checkout, that provider's own terms will also apply to that dealing.
16Your rights under the Australian Consumer Law
Nothing here takes away your consumer rights.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under that law, or under any other law that cannot be excluded by agreement.
For major failures with a service, you are entitled to cancel your service contract and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If a failure does not amount to a major failure, you are entitled to have the problem with the service fixed and, if this is not done within a reasonable time, to cancel your contract and obtain a refund for the unused portion.
Where we are permitted by law to limit our liability for failing to meet a consumer guarantee, and it is fair and reasonable for us to do so, our liability is limited to supplying the service again, or paying the cost of having it supplied again.
17If you are outside Australia
We are based in Australia. If you are a consumer somewhere with mandatory consumer protections, nothing in these terms limits rights you have under the law of that place that cannot be excluded by agreement.
If you are a consumer in the European Union or the United Kingdom, you normally have fourteen days to withdraw from a distance contract for digital content. Because we supply access immediately, we ask you at checkout to consent to immediate supply and to acknowledge that you lose the withdrawal right once supply begins. If you did not give that consent, you keep the fourteen-day right.
18Our liability
This section applies only so far as the law allows, and is subject in every case to sections 16 and 17.
Apart from the guarantees that cannot be excluded, and any express promise made in these terms, the service is provided as it is. We do not promise that it will be uninterrupted or error free, that its clinical content will be accurate or current, or that using it will improve your performance in any assessment.
To the extent permitted by law, we are not liable for:
- loss or damage arising from a clinical decision, examination technique or patient interaction that was informed by the service. The service is a simulation and section 4 explains its limits;
- an examination result, academic outcome, placement, employment or registration decision that goes against you;
- indirect or consequential loss, or loss of profits, revenue, goodwill, opportunity or anticipated savings;
- loss of data, beyond our obligation to take reasonable care and to keep reasonable backups;
- anything caused by your own breach of these terms, by your failure to keep your credentials secure, or by an event genuinely outside our reasonable control.
Where our liability can be limited but not excluded, our total liability to you for all claims connected with the service in any twelve month period is limited to the greater of the amount you paid us in that period, or AUD $100.
Our liability is reduced to the extent your own act or omission, or that of your institution, caused or contributed to the loss.
Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud, for death or personal injury caused by our negligence, or under the Australian Consumer Law.
19Indemnity
If someone brings a claim against us because you used the service unlawfully, breached section 8 or our Usage Policy, infringed another person's rights, or entered real patient information into the service, you agree to cover the reasonable costs, losses and legal fees we actually incur as a result.
This does not apply to the extent the claim was caused by our own breach, negligence or wrongful act. We will tell you promptly about any claim we want covered, will not settle it without asking you first, and will take reasonable steps to keep the cost down. You may take over the defence of the claim if you wish.
20Changes to these terms
We may update these terms as the service changes or the law requires. The version and date at the top show when they last changed.
If a change is material and disadvantages you, we will give you at least 30 days notice by email or in the app before it takes effect. If you do not accept the change, you may close your account before the change starts and, if you have paid for something you have not used, we will refund the unused part. Minor changes, such as correcting an error or clarifying wording, may take effect immediately.
Continuing to use the service after a change takes effect means you accept the updated terms.
21Governing law and resolving disputes
These terms are governed by the law of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that hear appeals from them. If you are a consumer living somewhere else, this does not deprive you of the protection of the mandatory laws of the place you live, or of your right to bring proceedings there where the law gives you that right.
If something goes wrong, please contact us first at [email protected]. Most problems are resolved quickly that way. We both agree to try in good faith to resolve a dispute between us before starting proceedings. Nothing in this section stops either of us from seeking urgent injunctive relief, or from making a complaint to a regulator or ombudsman.
22General
These terms, together with our Privacy Policy, our Usage Policy and our End User Licence Agreement, are the whole agreement between you and us about the service. Where they are inconsistent, these terms prevail.
If any part of these terms is found to be unenforceable, that part is severed and the rest continues to apply. If we do not enforce a right straight away, we do not lose it.
You may not transfer your rights under these terms without our consent. We may transfer ours to a company that acquires our business, provided your rights are not reduced, and we will tell you if that happens.
